    Default if you sell new items

    should you be a business seller ?

    do you think ebid should clamp down on this ?

    is it right that as a none business seller these tax dodgers can get away with not giving customers proper service distance selling regulations etc. therefore denying a buyer thier rights ?

    I havent really thought about it..but you do have a point..maybe there would be less scams ?

    So where would i fit in here I have sitting in my garage and have done for a few years (feels like it) loads of New babies clothes, but now I would just love to just get rid of them, you see I brought them ages ago thinking i would move into the direction of online selling (worried about my full time job at the time and needed summit to fall back onto), but then i managed to get another full time job, dont have anytime to list them, and when i do would sell them at less then i payed for them


    but would advertise them as new as they are, but i am no tax dodger, jeeze they get enough off me already, tax my wages and my bank.

    Hi Merlin you have got me thinking now as I have some items for sale new but they are just stuff that OH decided didn't want now, he had not worn them or even took tags off. Am I breaking any rules? Would appreciate any help/criticism/advice.

    Why New Items ? any one who buys or makes to sell is technically a business, There are many sellers around who buy used items to sell on and many sellers who have new items as gifts which they sell on, it is never going to be a clear cut case and it is up to the authorities to decide if anyone is breaking the trading regulations.

    It does not matter what you sell. New or old.
    If you buy something to sell at a profit then that is called doing business and as such Revenue and Customs would expect you to be classed as self employed.
    Therefore you are a business seller.

    You can't tell just from "new" that somebody is running a business, it just makes it likely. But if something's been bought for personal use, never used, and then is being sold on, that's still a private sale. If something's been bought for selling, it's a business transaction however long it's sat in a garage in the meantime, I'd say. Two things are taken into account that I know of - intent, and volume. So anybody selling huge amounts is considered a trader, and anybody buying in order to sell is also in business. Doesn't matter if you make a profit or not, the intent is what matters.
