My Mom has the same problem with her HP all in one, wonder if it's an HP problem?

I've got an HP all in one and I don't actually understand what the problem is. Crop *when*? Goes wrong *how*? Whatever it is I'm pretty sure mine's not doing it, but perhaps I'm using it differently.
Mine's a Canon so it is not an HP problem (Hire purchase? Brown sauce? ;))
What I mean is that sometimes it scans precisely the area of the document I've put in and others it has a big wide margin of white

I'm fairly certain it is my fault - or the scanner would make the same mistake all the time.

Before you start to scan, make sure you see the superficial dotted/dashed outline on the image, so you can grab it and drag where you need it.
No, there isn't one of those so I can't.
On the HP the dashed line to resize/reshape only pops up on preview, so you can get a precise fit. I suspect that the black line top edge is fooling the scanner into thinking there's content there, so it's not cropping the empty space (cos it ain't empty). Suss what's causing the line (problem with the lid liner, document position,whatever) and you can probably get it to crop properly.
